Applying for a divorce

Here’s what you can expect if you apply for a divorce. Start the process by booking a call with our experienced family law solicitors. 

STEP ONE

Application

Prepare and submit your divorce statement and application.

STEP TWO

20 Week Reflection

An opportunity to reflect on your decision and work through any child or financial issues.

STEP THREE

Conditional Order

This stage says the court sees no reason why you cannot divorce. It was previously called a Decree Nisi.

STEP FOUR

6 Week Wait

After the conditional order, you need to wait six weeks and one day (a cooling off period) before your Final Order.

STEP FIVE

Final Order

The legal document that ends your marriage. It was previously called a Decree Absolute.

In most cases, a divorce will not be finalised in less than six months.

→ A Clean Break Order stops you or your spouse from making a financial claim against each other in the future.

Eligibility: you do not have any joint assets and you both agree to the order. Our solicitors will assess whether this is the right option for you.

Divorce & Child Arrangements Order £2500 +VAT

– Solicitor consultation
– Divorce application
– Child Arrangements Order

→ If you’ve reached an agreement about your child arrangements, the Order will make your agreement legally binding.

This package is for the application only. If your application requires court representation, additional charges will apply. Our solicitors will assess whether this is the right option for you.

We’ll help you to plan your next steps and explore your options. We find that reaching an agreement early on about parenting or financial issues can save you time and money in the end.

What Issues Do We Need to Agree on?

If you and your spouse have children, you will need to reach an agreement about child arrangements. For example:
  • where your children will live
  • how much time they will spend with each parent, and
  • how you’ll financially support them
If you can agree on these issues between yourselves, we can make your agreement legally binding through a court order.
We can also help you to reach an agreement. And you do not need to wait until you reach an agreement to start your divorce application.

We can guide you on next steps, options and costs in relation to your children or dividing finances, such as a Clean Break Order or a Consent Order.  It is important to remember that whilst a Final Order legally ends your marriage, it does not end your financial commitments to your former spouse.

What Court Order Do I Need?

Where possible, court action should be a last resort when a case involves children. If you do need to apply to the court, or if the court process has already begun, we can provide urgent advice and representation.

There are a number of options available to you.

  • A Child Arrangements Order will ask the court to decide on issues relating to contact and visitation
  • A Prohibited Steps Order can be used to ask the court to stop contact with a certain person
