If you do not want your spouse to benefit from your Estate and are not legally divorced yet, we recommend writing or updating your will with your new wishes. If you choose not to update your will, the terms of your will remain in place until you receive your Final Order.

Yes, it’s a good way to guide your loved ones. However, remember that: 

  • in order to be legally valid, your will needs to be witnessed by two people;
  • you may wish to take advice if you have a more complex financial or family situation;

What happens to my will after I divorce?

Until your divorce is finalised (the Decree Absolute has been issued), anything that you have gifted to your ex-spouse in your Will would be passed on to the next beneficiary who is entitled to it. If there is no other named beneficiary, your estate will have to be dealt with under the intestacy rules.
