The UK government is to introduce a new ‘no-fault’ divorce. The new law, which will apply to marriages and civil partnerships, will remove the need for couples to blame each other,  or provide evidence of the other spouse’s behaviour. It will also stop one partner refusing a divorce if the other party wants one. In addition, a new option will allow couples to apply for a divorce jointly. The changes will introduced as soon as possible by Parliament. Find out more: Government Announcement.

Currently, couples seeking divorce are required to provide evidence of 1 or more of 5 facts; 3 are based on ‘fault’ and 2 are based instead on a period of separation.  The 5 facts are: adultery, behaviour, desertion, 2 years’ separation (if the other spouse consents to the divorce) and 5 years’ separation (otherwise).
